Crystal K Media, LLC Terms of Service Agreement

This Terms of Service Agreement (“Agreement”) is entered into by and between the Photographer (Crystal Kolosik, Crystal K Media LLC) and the Client for the purpose of providing real estate photography and related media services.

1. Services Provided

The Photographer agrees to provide real estate photography services as outlined in the selected bundle or individual service. Services may include, but are not limited to: interior photography, exterior photography, drone/aerial photography, videography, floor plans, 3D tours, and photo or video editing.

2. Scheduling & Cancellations

Appointments must be scheduled at least 48 hours (2 days) in advance. Drone/aerial photography requires FAA and/or LAANC authorization and must be booked at least 72 hours (3 days) in advance.

The Client must provide at least 12 hours’ notice to cancel or reschedule an appointment. Cancellations with less than 12 hours’ notice may incur a cancellation fee.

Weather-dependent services (including exterior, drone, and twilight photography) may be rescheduled at the Photographer’s discretion to ensure quality and safety.

3. Client Responsibilities

The property must be clean, staged, and photo-ready at the scheduled time of the shoot. The Photographer is not responsible for cleaning, organizing, or staging the property. At her discretion, the Photographer may offer light assistance to improve photo presentation; however, this does not guarantee the removal or rearrangement of all items.

If the property is not photo-ready upon arrival, or if conditions are deemed unsafe to enter or work within, the Photographer reserves the right to decline, pause, or reschedule the shoot at her discretion. Conditions that may be considered unsafe or unworkable include, but are not limited to:

  • Excessive clutter, trash, or unprepared spaces

  • Active construction that creates unsafe working conditions (e.g., exposed hazards, unsecured materials, or lack of safe access)

  • Aggressive or unsecured animals

  • Unsafe occupants or hostile environments

  • Unsanitary or unhealthy conditions

  • Any situation that poses a safety risk to the Photographer or equipment

In such cases, a return trip or rescheduling fee may apply.

4. Payment

Full payment is due prior to downloading any final images or deliverables from the Photographer’s delivery system (e.g., Spiro). The Photographer reserves the right to withhold delivery until payment is received in full. Late or unpaid balances may result in delivery delays.

5. Delivery

Final images will be delivered digitally within 2–3 business days, unless otherwise agreed upon. Delivery timelines may vary based on the size and complexity of the project. Video, floor-plans, and virtual 3D tour deliverables may require additional processing time. 

All final media will be delivered via the Photographer’s delivery platform (e.g., Spiro). 

Virtual 3D tours will be delivered via a shareable link hosted on Kuula.

6. Licensing & Usage

The Client is granted a non-exclusive, non-transferable license to use the images for real estate marketing purposes for the specific property photographed. This license is intended for use during the active listing period and may be reused if the same property is re-listed for sale or rent by the same Client.

Passive display of the images on MLS, Zillow, or similar real estate platforms after the sale, rental, or removal of the listing is permitted.

Reuse of the images by a different agent, brokerage, or third party, or for marketing a different property or unrelated promotional purposes, is not permitted without written consent from the Photographer.

The Photographer retains full copyright ownership of all images and reserves the right to use the images for business promotion, portfolio use, website content, and social media marketing.

7. Image Alteration Restrictions

Images may not be materially altered in a way that misrepresents the property. Prohibited alterations by the Client include, but are not limited to:

  • Virtual staging, including AI-generated staging

  • Day-to-twilight editing or artificial lighting changes, including AI-generated twilight editing

  • Sky replacements

  • Changing wall, floor, or fixture colors

  • Removing or altering permanent features of the property

  • AI-generated enhancements or generative edits

  • Heavy filters or edits that distort accurate color representation

Minor formatting adjustments such as cropping, resizing, brightness adjustments, and the addition of MLS-required watermarks or brokerage logos for marketing purposes are permitted.

8. Liability

The Photographer maintains general liability insurance. The Photographer shall not be held responsible for accidents, injuries, or property damage occurring during the photo shoot that are outside the Photographer’s direct control.

The Client agrees to ensure the property is safe and accessible at the time of the shoot. Drone operations will comply with FAA regulations and applicable airspace restrictions, and all reasonable precautions will be taken to minimize risk.

9. Agreement
